  1. Net Neutrality and News: Long term solutions?These are the two issues in brief

    -Should internet providers be allowed to give some content priority over others

    This is why both are controversial

    -On one hand, ISPs should be allowed to decide how they want to do business. On the other hand, there are privacy issues, and some of the things we use the internet for would become useless. For example, a lot of businesses use something called "secure shell tunnels". These things would be given low bandwidth priority, and anything that would require a high speed internet connection and a secure channel would stop working. Giving some content priority over other content means your ISP, or a machine owned by your ISP, would have to look at where the content was coming from. There is also a sharp divide over how free people feel the internet should be.

    -On one hand, a News organization has a first amendment right which should be protected. It also would put an undue amount of pressure on the people reporting the news if they could be fined for making mistakes and getting things wrong. On the other hand, the quality of news reporting itself has been suffering, and people have fewer and fewer options when they try to be more informed about their world.

    I think a great way to solve these problems is standards organizations. Basically, they certify how free, private, and anonymous an ISP is, and how accurate and objective a news station is. This gives companies an incentive to do things the right way, gives consumers more of a choice and a more competitive market, and keeps the law from infringing on people’s civil liberties. A standards organization could agree to let themselves be inspected by the government, which would solve the "who watches the watchmen" problem.

  2. Standards organizations typically deal with very concrete and definable things, like how long is a second, or how far is a meter. A standards organization would have a very difficult time determining what is a legitimate way for an ISP to shape its traffic. These are opinionated things mixed with very technical things.

    A lot of people are confused and think Net Neutrality is about cencorship anyway, which it isn’t and never has been.References :

  3. If the government sets up the standards organization, it doesn’t solve your first amendment problems. A private organization, like FINRA for stock brokers would be plausible. They could allow their trademarked seal to be used or not used and be totally transparent about how they make those decisions. Organizations seeking a branding of fairness would attempt to comply with the standards of that organization.

    Those types of organizations are VERY hard to begin because their only asset is their reputation. A new organization has no reputation. It would have to be set up by an existing entity that emanates trust, such as Pulitzer.

    But that doesn’t really have anything to do with net neutrality.

    In my opinion, both issues come down to competition law (called antitrust law here in the US due to an historical accident). Biased news sources are nothing new. Dominant news sources are. That began with television, which initially required licenses from the FCC to broadcast, since there is a limited range of broadcastable bandwidth, and such licenses came with requirements of news coverage and public service announcements, among other standards. With the advent of cable, followed shortly by cable news, and the relaxation of Federal standards over ownership of multiple news sources within the same jurisdiction, and conglomeration.

    Today, NewsCorp, GE, Disney, and Time Warner own pretty much all of television news with Viacomm owning much of entertainment television. Further, there are negotiations between GE and Comcast which could put ownership of NBC and MSNBC into the hands of a the largest cable company in America. An increasing number of local broadcast stations are owned and opperated by these same national networks, especially in the major media markets, and when they aren’t, they are subject to certain standards of these companies. At the same time, the newspaper industry is dying, being killed by the internet and what newspapers are left are suffering the same fate as broadcast news, with NewsCorp owning 2 of the 4 major papers in New York and 2 of the 6 broadcast station, as well as several cable channels including Fox News that aren’t subject to FCC regulation.

    By enforcing and taking seriously the rules that prevent a single entity from owning multiple sources of news available in the same jurisdiction, you ensure multiple voices, which is by far the best way to ensure good information.

    Enter net neutrality, which is an important tool in this fight. Notice the brief mention above of the Comcast GE deal. Imagine, if you will, Comcast improving the speed of access to MSNBC’s site, allowing their online video in HD to work better. Plus, content providers and content distributors fight all the time, so such a deal would give Comcast an incentive to underpay Newscorp, Viacomm, Disney, and other minor content providers because a stall in negotiation would help their subsidiary, NBC. Plus, without net neutrality, minor content providers would have no leverage to ensure that people can access HD content with fast service. Remember, in most areas, high speed internet providers are virtual local monopolies. They have no need to acquiesce to public concerns. There is no competitor to go to if people don’t like their provider. That is not an incentive structure you want to set up.

    Personally, I think ISPs should be treated as virtual utilities, since the barriers to entry into the market are so high that they almost always end up with locol monopolies in all but the biggest markets. Take New York for example, in Manhattan, Time Warner is the major ISP with RCN as a minor competitor and Verizon steadily breaking in to the market. In the other 4 boroughs, Cablevision has a monopoly with no other cable companies available, Verizon’s fiber optic service still unavailable in most neighborhoods, and many apartment buildings with deals that prevent satellite dishes and many houses with no line of site to allow them anyway (besides, satellite is unsatisfactory for upload speeds, since that has to be done via phone line anyway). If those companies have the authority to abuse that power, they will. Already, they routinely do.

    And that’s why I’m for Net Neutrality.References :
